DEFINITIONS

Terms used in the Regulations mean:

1. Customer – a natural person, legal person, or an organizational unit that is not a legal person, but which special regulations grant legal capacity, who places an Order within the Store

2. Consumer – according to Article 22[1] of the Civil Code, a natural person performing a legal transaction with an entrepreneur not directly related to their business or professional activity

3. Civil Code – the Act of April 23, 1964 (Journal of Laws No. 16, item 93, as amended)

4. Regulations – these Regulations defining the general terms of sale and the rules for providing electronic services within the BDHappyDog online store

5. Online Store (Store) – the online service available at https://www.bdhappydog.pl, through which the Customer can place Orders

6. Goods – products presented in the Online Store

7. Sales Agreement – a sales agreement for Goods as defined by the Civil Code, concluded between B&B Barbara Białyńska and the Customer, using the Online Store's service

8. Consumer Rights Act – the Act of May 30, 2014, on consumer rights (Journal of Laws of 2014, item 827)

9. Act on the Provision of Electronic Services – the Act of July 18, 2002, on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended)

10. Order – the Customer’s declaration of intent aimed directly at concluding a Sales Agreement, specifying in particular the type and quantity of Goods

GENERAL PROVISIONS

1. These Regulations define the rules for using the online store available at https://www.bdhappydog.pl.

2. These Regulations are the regulations referred to in Article 8 of the Act on the Provision of Electronic Services.

3. The online store available at https://www.bdhappydog.pl is operated by B&B Barbara Białyńska, NIP 7631236201, REGON 302669755.

4. These Regulations specify in particular:

- the conditions and rules for placing Orders electronically within the online store;

- the rules for concluding Sales Agreements using services provided within the Online Store.

5. Using the online store is possible provided that the Customer’s telecommunication system meets the following minimum technical requirements: To ensure the store functions correctly, we recommend using up-to-date versions of web browsers.

6. To use the online store, the Customer must obtain access to a computer workstation or an end device with Internet access.

7. Only adults can use the store.

8. Customers can access these Regulations at any time via a link on the homepage of the service https://www.bdhappydog.pl and download and print them.

RULES FOR USING THE ONLINE STORE

1. A condition for using the Online Store is registration within its system.

Registration takes place by filling out and accepting the registration form available on one of the Store’s pages.

A condition of registration is accepting the Regulations and providing personal data marked as mandatory.

B&B Barbara Białyńska may revoke the Customer's right to use the Online Store or restrict access to part or all of its resources with immediate effect if the Customer violates the Regulations, particularly if the Customer:

- provided false, inaccurate, or outdated information during registration, misleading or infringing on third-party rights,

- used the online store to infringe on the personal rights of third parties, in particular, the personal rights of other store customers,

- engaged in other behavior deemed by B&B Barbara Białyńska as contrary to the applicable law or general rules of Internet use, or which harms the company’s reputation.

2. To ensure the security of communication and data transmission related to the services provided through the Website, the BDHappyDog Online Store implements technical and organizational measures appropriate to the level of risk to protect against unauthorized acquisition and modification of personal data transmitted over the Internet.

3. The Customer is particularly obliged to:

- use the BDHappyDog Online Store in accordance with the laws applicable in the Republic of Poland, the provisions of the Regulations, and general Internet usage principles.

- refrain from providing or transmitting content prohibited by law, such as content promoting violence, defamatory content, or content infringing on the personal rights and other rights of third parties,

- use the Online Store in a manner that does not disrupt its functioning, particularly through the use of specific software or devices,

- refrain from actions such as sending or placing unsolicited commercial information (spam) within the Online Store,

- use the Online Store in a manner that does not inconvenience other customers,

- use all content placed in the Online Store only for personal use.

PROCEDURE FOR CONCLUDING A SALES AGREEMENT

1. To conclude a Sales Agreement via the Online Store, the Customer must visit the website https://www.bdhappydog.pl and select the Goods by performing subsequent technical steps based on the messages displayed to the Customer and the information available on the website.

2. The Customer selects the ordered Goods by adding them to the cart.

3. During the Order placement – until the button confirming the Order is clicked – the Customer has the option to modify the entered data and selected Goods.

4. After the Customer provides all required data, an Order summary will be displayed, containing, among others, a description of the selected Goods or services, the total price, and all additional costs.

5. To send an Order, the Customer must accept the Regulations, provide mandatory personal data, and click the button confirming the Order.

6. Information about Goods on the Store's website, including their descriptions, technical specifications, and prices, constitutes an invitation to conclude an agreement, as defined in Article 71 of the Civil Code. Placing an Order constitutes a declaration of intent to conclude a sales agreement with BDHappyDog, in accordance with the Regulations.

7. The Sales Agreement is concluded in Polish, in accordance with the Regulations.

DELIVERY

1. Ordered Goods are delivered via:

- Courier companies

- Inpost Parcel Lockers

It is possible to pick up the ordered goods in person at our company: B&B Barbara Białyńska, BDHappyDog, Ul. Szkolna 23, 64-510 Nowa Wieś, Poland. Personal pickup is available Monday to Friday from 8:00 AM - 6:00 PM.

2. Delivery within Poland takes 1-2 business days via courier or Inpost Parcel Lockers. International delivery may take 7+ days.

3. If Goods are damaged during delivery, please report the defect to the courier and contact us as soon as possible. This does not affect your statutory warranty rights.

PRICES AND PAYMENT METHODS

1. The prices of the Goods are given in Polish zlotys and include all components, including VAT.

2. The online store accepts the following payment methods:

- Traditional bank transfer: To pay for your order, please make a transfer to our account at SAN BP PL 44 1090 1391 0000 0001 2324 5695.

- Online transfer or credit card payment – online payment services are provided by: Przelewy24.pl, PayPal.

- Payment via PayPal.

- Cash payment – in case of personal collection.

3. In the event that a refund is required for a transaction made by the customer using a payment card, the seller will refund the amount to the bank account associated with the customer's payment card.

RIGHT OF WITHDRAWAL FROM THE CONTRACT

Only a Customer who is a Consumer within the European Union has the right to withdraw from the contract within 14 days. According to Article 22(1) of the Civil Code, a Consumer is considered a natural person who enters into a legal transaction with an entrepreneur that is not directly related to their business or professional activity.

Right of withdrawal from the contract

Customers residing in the European Union have the right to withdraw from this contract within 14 days without providing any reason. The withdrawal period expires 14 days after the day on which you acquired possession of the goods or when a third party, other than the carrier and indicated by you, acquired possession of the goods.

To exercise the right of withdrawal, you must inform us (B&B Barbara Białyńska, Ul. Szkolna 23, 64-510 Nowa Wieś, tel. +48 660 794 487, kontakt@bdhappydog.pl) of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post, fax, or email). You may use the model withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send the information regarding the exercise of your right of withdrawal before the withdrawal period has expired.

Effects of withdrawal from the contract

In the event of withdrawal from this contract, we will reimburse all payments received from you, including the costs of delivery (except for additional costs resulting from your choice of a delivery method other than the least expensive standard delivery method offered by us), without undue delay and in any event no later than 14 days from the day on which we are informed of your decision to withdraw from this contract. We will make the reimbursement using the same means of payment as you used for the original transaction unless you have expressly agreed otherwise; in any case, you will not incur any fees as a result of this reimbursement.

We will collect the goods. You will have to bear the direct costs of returning the goods. You are only liable for any diminished value of the goods resulting from handling them in a manner other than what is necessary to establish their nature, characteristics, and functioning.

The right of withdrawal from the contract by the consumer is excluded in the case of:

  • Contracts where the subject of the service is a non-prefabricated item, manufactured according to the consumer's specifications or serving to satisfy their individualized needs.
  • Contracts where the subject of the service is an item that is not in new condition, meaning it has been used by an animal.

COMPLAINTS REGARDING GOODS

For Consumers:

We are obliged to deliver goods free from defects. The statutory warranty for defects (warranty for defects) applies within the scope defined in Article 556 and Articles 556[1]-556[3] and subsequent articles of the Civil Code.

Complaints may be submitted:

- In writing to the address: B&B Barbara Białyńska, Ul. Szkolna 23, 64-510 Nowa Wieś.

- Via email to: kontakt@bdhappydog.pl.

- Using the contact form available on the Store’s website.

If you are exercising warranty rights – if we deem it necessary to process the complaint, you are required to deliver the defective product at our expense to the above postal address. If, due to the nature of the goods or their installation, delivery would be excessively difficult, you are required to make them available to us at the location where they are situated. We will respond to the complaint promptly, no later than 14 days from the date of its submission.

We are liable under the warranty if a physical defect is found within two years from the date of delivery of the goods to you. If the subject of the sale is a used movable item, the warranty liability is one year from the time of its delivery.

FINAL PROVISIONS

1. The court competent for resolving disputes with Consumers is the court competent under the applicable provisions of the Code of Civil Procedure.

2. Any disputes arising between B&B Barbara Białyńska and a Customer who is not a Consumer shall be submitted to the court competent for our registered office.

3. In matters not regulated by these Terms and Conditions, the applicable provisions of law shall apply, in particular, the provisions of the Civil Code (consolidated text: Journal of Laws of 2014, item 121, as amended) and the Act of May 30, 2014, on consumer rights (Journal of Laws of 2014, item 827). If any provisions of these Terms and Conditions are inconsistent with the mandatory provisions of consumer law, the applicable legal regulations shall apply.
