GENERAL PROVISIONS

This privacy policy of the Online Store is for informational purposes, which means it does not create obligations for the Service Users or Customers of the Online Store. The privacy policy primarily contains the rules regarding the processing of personal data by the Administrator in the Online Store, including the legal grounds, purposes, and periods for processing personal data, as well as the rights of individuals whose data is processed, and also information on the use of cookies and analytical tools in the Online Store.

The administrator of personal data collected through the Online Store is Barbara Białyńska, conducting business under the name B&B Barbara Białyńska (address of the place of business and delivery address: ul. Szkolna 23, 64-510 Nowa Wieś), registered in the Central Registration and Information on Business conducted by the Minister responsible for economy, NIP 7631236201, REGON 302669755, email address: kontakt@bdhappydog.pl - hereinafter referred to as the "Administrator" and being simultaneously the Service Provider of the Online Store and the Seller.

Personal data in the Online Store is processed by the Administrator in accordance with applicable legal regulations, particularly in accordance with the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) - hereinafter referred to as the "GDPR" or the "GDPR Regulation".

Using the Online Store, including making purchases, is voluntary. Similarly, the provision of personal data by the user of the Online Store or Customer is voluntary, with the exception of two cases: (1) entering into contracts with the Administrator - failure to provide personal data necessary for entering into and performing the Sales Agreement or the Electronic Service Agreement with the Administrator, as indicated on the Online Store's website and in the Online Store's Terms and Conditions and this privacy policy, results in the inability to conclude the agreement. Providing personal data is a contractual requirement, and if the person whose data is concerned wishes to conclude the agreement with the Administrator, they are required to provide the required data. The specific scope of data required to conclude the agreement is indicated on the Online Store's website and in the Online Store's Terms and Conditions; (2) statutory obligations of the Administrator - the provision of personal data is a statutory requirement resulting from generally applicable laws imposing an obligation on the Administrator to process personal data (e.g., processing data for the purpose of maintaining tax or accounting records), and failure to provide such data will prevent the Administrator from fulfilling these obligations.

The Administrator takes particular care to protect the interests of individuals whose personal data is processed, and in particular, is responsible for ensuring that the data collected is: (1) processed lawfully; (2) collected for specified, legitimate purposes and not further processed in a way incompatible with those purposes; (3) accurate and adequate for the purposes for which it is processed; (4) stored in a form which permits identification of the data subjects, no longer than is necessary for the purposes for which the data is processed; and (5) processed in a manner that ensures appropriate security of personal data, including protection against unauthorized or unlawful processing and accidental loss, destruction, or damage, using appropriate technical or organizational measures.

Taking into account the nature, scope, context, and purposes of the processing, as well as the risks of violating the rights or freedoms of individuals with varying probabilities and severity of the threat, the Administrator implements appropriate technical and organizational measures to ensure that processing is carried out in accordance with this Regulation and to be able to demonstrate compliance. These measures are reviewed and updated when necessary. The Administrator uses technical means to prevent unauthorized access to or modification of personal data transmitted electronically.

All words, expressions, and acronyms appearing in this privacy policy and starting with a capital letter (e.g., Seller, Online Store, Electronic Service) should be understood in accordance with their definition provided in the Online Store's Terms and Conditions available on the Online Store's website.

LEGAL GROUNDS FOR DATA PROCESSING

The Administrator is entitled to process personal data in cases where – and to the extent that – at least one of the following conditions is met: (1) the person whose data is concerned has given consent to the processing of their personal data for one or more specified purposes; (2) processing is necessary for the performance of a contract to which the data subject is a party, or to take steps at the request of the data subject prior to entering into a contract; (3) processing is necessary for compliance with a legal obligation to which the Administrator is subject; or (4) processing is necessary for the purposes of legitimate interests pursued by the Administrator or a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject, which require protection of personal data, particularly when the data subject is a child.

Processing of personal data by the Administrator requires the existence of at least one of the legal bases indicated in point 2.1 of the privacy policy. Specific grounds for processing personal data of Service Users and Customers of the Online Store by the Administrator are indicated in the next section of the privacy policy – with respect to the specific purpose of processing personal data by the Administrator.

PURPOSE, BASIS, AND PERIOD OF DATA PROCESSING IN THE ONLINE STORE

The purpose, basis, period, and recipients of the personal data processed by the Administrator result from the actions taken by the Service User or Customer in the Online Store or by the Administrator. For example, if the Customer decides to make a purchase in the Online Store and chooses to pick up the purchased Product in person instead of having it delivered by courier, their personal data will be processed for the purpose of fulfilling the Sales Agreement but will not be shared with the courier delivering the shipments on behalf of the Administrator.

 

 

RECIPIENTS OF DATA IN THE ONLINE STORE

For the proper functioning of the Online Store, including the execution of concluded Sales Agreements, it is necessary for the Administrator to use the services of external entities (such as software providers, couriers, or payment processors). The Administrator only uses the services of such processors who provide sufficient guarantees of implementing appropriate technical and organizational measures to ensure that the processing meets the requirements of the GDPR and protects the rights of the individuals concerned.

Data sharing by the Administrator does not take place in every case and not with all recipients or categories of recipients specified in the privacy policy – the Administrator shares data only when necessary to achieve the specific purpose of processing personal data and only to the extent necessary to do so. For example, if the Customer uses in-store pickup, their data will not be shared with the courier cooperating with the Administrator.

Personal data of Service Users and Customers of the Online Store may be shared with the following recipients or categories of recipients:

carriers / freight forwarders / courier brokers / entities handling the warehouse and/or shipping process – in the case of a Customer who uses the postal or courier delivery method in the Online Store, the Administrator shares the collected personal data with the selected carrier, freight forwarder, or intermediary handling shipments on behalf of the Administrator, and if the shipment is made from an external warehouse – with the entity handling the warehouse and/or shipping process – to the extent necessary to complete the delivery of the Product to the Customer.

entities handling electronic payments or credit card payments – in the case of a Customer who uses electronic or credit card payments in the Online Store, the Administrator shares the collected personal data with the selected entity handling such payments in the Online Store on behalf of the Administrator to the extent necessary to process the payment made by the Customer.

survey system providers – in the case of a Customer who has agreed to provide feedback on the concluded Sales Agreement, the Administrator shares the collected personal data with the selected entity providing the survey system for reviewing Sales Agreements in the Online Store on behalf of the Administrator to the extent necessary to allow the Customer to provide feedback via the survey system.

providers of services supplying the Administrator with technical, IT, and organizational solutions enabling the Administrator to conduct business, including the Online Store and the Electronic Services offered through it (including providers of software for managing the Online Store, email and hosting providers, and providers of software for business management and technical support for the Administrator) – the Administrator shares the collected personal data with the selected provider acting on its behalf only in the case and to the extent necessary to achieve the specific purpose of data processing in accordance with this privacy policy.

providers of accounting, legal, and advisory services providing the Administrator with accounting, legal, or advisory support (including accounting offices, law firms, or debt collection agencies) – the Administrator shares the collected personal data with the selected provider acting on its behalf only in the case and to the extent necessary to achieve the specific purpose of data processing in accordance with this privacy policy.

providers of social media plugins, scripts, and other similar tools available on the Online Store's website, which allow the visitor's browser to download content from the providers of those plugins (e.g., logging in using social media account credentials) and transfer personal data to those providers for that purpose, including:

Facebook Ireland Ltd. – The Administrator uses social media plugins from Facebook (e.g., Like, Share buttons, or login using Facebook account credentials) on the Online Store's website, and as a result, collects and shares personal data of the Service User with Facebook Ireland Ltd. (4 Grand Canal Square, Grand Canal Harbour, Dublin 2 Ireland) to the extent and in accordance with the privacy policies available here: https://www.facebook.com/about/privacy/ (this data includes information about actions on the Online Store’s website – including information about the device, visited sites, purchases, displayed ads, and the way the services are used – regardless of whether the Service User has a Facebook account and is logged into Facebook).

PROFILING IN THE ONLINE STORE

The GDPR Regulation imposes an obligation on the Administrator to inform about automated decision-making, including profiling, as mentioned in Article 22(1) and (4) of the GDPR Regulation, as well as – at least in these cases – important information about the principles of decision-making, as well as the meaning and expected consequences of such processing for the individual to whom the data pertains. Bearing this in mind, the Administrator provides information about possible profiling in this section of the privacy policy.

The Administrator may use profiling in the Online Store for direct marketing purposes, but decisions made based on it by the Administrator do not concern the conclusion or refusal of the Sales Agreement, nor the possibility of using Electronic Services in the Online Store. The result of using profiling in the Online Store may be, for example, granting a discount to a person, sending them a discount code, reminding them of unfinished purchases, sending a proposal for a Product that may match the person’s interests or preferences, or offering better terms compared to the standard offer of the Online Store. Despite profiling, the person freely decides whether they want to use the discount received in this way, or the better terms and make a purchase in the Online Store.

Profiling in the Online Store involves automatic analysis or forecasting of a person’s behavior on the Online Store website, for example, by adding a specific Product to the cart, viewing a specific Product page in the Online Store, or analyzing the person’s previous purchase history in the Online Store. A prerequisite for such profiling is the Administrator having personal data of the person to then send, for example, a discount code.

The data subject has the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning them or similarly significantly affects them.

RIGHTS OF THE DATA SUBJECT

Right of access, rectification, restriction, deletion, or portability – the data subject has the right to request access to their personal data, rectification, deletion ("right to be forgotten"), or restriction of processing, as well as the right to object to processing, and also the right to data portability. The detailed conditions for exercising the above rights are specified in Articles 15-21 of the GDPR Regulation.

Right to withdraw consent at any time – a person whose data is processed by the Administrator based on consent (according to Article 6(1)(a) or Article 9(2)(a) of the GDPR Regulation), has the right to withdraw consent at any time without affecting the lawfulness of processing based on the consent before its withdrawal.

Right to lodge a complaint with a supervisory authority – a person whose data is processed by the Administrator has the right to lodge a complaint with a supervisory authority in the manner and procedure specified in the provisions of the GDPR Regulation and Polish law, in particular the Personal Data Protection Act. The supervisory authority in Poland is the President of the Personal Data Protection Office.

Right to object – the data subject has the right to object at any time – on grounds relating to their particular situation – to the processing of personal data concerning them based on Article 6(1)(e) (public interest or official authority) or (f) (legitimate interest of the administrator), including profiling based on these provisions. In such a case, the Administrator may no longer process this personal data unless they demonstrate the existence of overriding legitimate grounds for the processing, which take precedence over the interests, rights, and freedoms of the data subject, or the grounds for the establishment, exercise, or defense of legal claims.

Right to object to direct marketing – if personal data is processed for direct marketing purposes, the data subject has the right to object at any time to the processing of personal data concerning them for such marketing, including profiling, to the extent that the processing is related to such direct marketing.

To exercise the rights referred to in this section of the privacy policy, you can contact the Administrator by sending a written message or email to the Administrator's address provided at the beginning of the privacy policy or by using the contact form available on the Online Store's website.

COOKIES IN THE ONLINE STORE AND ANALYTICS

Cookies are small text information in the form of text files sent by the server and stored on the side of the person visiting the Online Store's website (e.g., on the hard drive of a computer, laptop, or on the smartphone's memory card – depending on which device the person is using to visit the Online Store). By default, most of the internet browsers available on the market accept the saving of cookies. Everyone has the possibility to set the conditions for using cookies via the settings of their own internet browser. This means that you can, for example, temporarily limit or completely disable the saving of cookies – however, in the latter case, it may affect certain functionalities of the Online Store (for example, it may become impossible to proceed with the Order process through the Order Form due to products not being remembered in the cart during the next steps of placing the Order).

The Administrator may use Google Analytics, Universal Analytics services provided by Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland) in the Online Store. These services help the Administrator to manage statistics and analyze traffic in the Online Store. The collected data is processed within the framework of the above services to generate statistics useful for administering the Online Store and analyzing traffic. These data are aggregated. By using these services in the Online Store, the Administrator collects data such as the sources and medium of visitors to the Online Store, their behavior on the website, information about devices and browsers from which the website is visited, IP and domain, geographical data, and demographic data (age, gender) and interests.
